Students may work as much as is required by their academic program, provided labor laws and other relevant laws are followed.&nbsp; USCIS regulations state that an F-1 student may be authorized by the DSO to participate in a CPT program.&nbsp; To grant authorization for a student to engage in CPT, a DSO at a SEVIS school will update the student\u2019s SEVIS record as being authorized for CPT that is directly related to their major area of study.&nbsp; Students may begin working with their CPT employer once they have received their updated I-20 reflecting the CPT work authorization and the start date has begun.<\/p>\n\n\n\n<p><strong>I-9 Requirements<\/strong><\/p>\n\n\n\n<p>Option 1:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unexpired Foreign Passport,<\/li>\n\n\n\n<li>Form I-20 (with DSO\u2019s employment authorization), and<\/li>\n\n\n\n<li>Form I-94 indicating F-1 nonimmigrant status.&nbsp; The \u201cAdmit Until Date\u201d must show D\/S.<\/li>\n<\/ul>\n\n\n\n<p>Option 2:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>US Driver\u2019s License that contains all the information stated in List B, Item 1;<\/li>\n\n\n\n<li>Form I-20 (with DSO\u2019s employment authorization); and<\/li>\n\n\n\n<li>Form I-94 indicating F-1 nonimmigrant status.&nbsp; The \u201cAdmit Until Date\u201d must show D\/S.<\/li>\n<\/ul>\n\n\n\n<p>The passport\/US driver\u2019s license establishes identity.&nbsp; The I-20 states at which college or university the student is enrolled and their CPT employment dates, while the I-94 verifies that the student entered the US in F-1 status.<\/p>\n\n\n\n<p><strong>Social Security Number<\/strong><\/p>\n\n\n\n<p>F-1 students must receive an internship offer before they can receive CPT authorization from their DSO.&nbsp; Guidelines website<\/a>&nbsp;for details.<\/p>\n\n\n\n<p><strong>On-Campus Location<\/strong>.&nbsp; On-campus employment must either be performed on one of Tarleton\u2019s campuses, (including on-location commercial firms which provide services for students on campus, such as the school bookstore or cafeteria), or at an off-campus location that is educationally affiliated with the school.&nbsp; Employment with on-site commercial firms, such as a construction company building a school building, which does not provide direct student services is not deemed on-campus employment.&nbsp; In the case of off-campus locations, the educational affiliation must be associated with the school\u2019s established curriculum or related to contractually funded research projects at the post-graduate level.<\/p>\n\n\n\n<p><strong>Part-Time.&nbsp;&nbsp;<\/strong>Employment must not exceed 20 hours a week while school is in session (i.e., part-time)<strong>.&nbsp;&nbsp;<\/strong>However, F-1 students may work on campus full time (i.e., more than 20 hours per week) when school is not in session during the school year (e.g., Christmas or spring break).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>F-1 students who have received special student relief on-campus employment authorization may work more than 20 hours per week while school is in session.&nbsp; These students will have remarks on their I-20s indicating such.<\/li>\n<\/ul>\n\n\n\n<p><strong>Summer Employment.<\/strong><strong>&nbsp;&nbsp;<\/strong>Students whose first or final semester at Tarleton is NOT summer may work full-time during the summer.&nbsp; Students may engage in OPT for any employer in any location for the duration of OPT authorization, provided the employment qualifies under OPT standards.&nbsp; Participating in OPT during one\u2019s studies is called&nbsp;<em>pre-completion OPT<\/em>&nbsp;while participating after program completion is called&nbsp;<em>post-completion OPT<\/em>.&nbsp; Most students choose to do post-completion OPT, especially those with STEM majors.&nbsp; OPT has a limit of 12 months per educational level.<\/p>\n\n\n\n<p>Tarleton sponsors our F-1 students\u2019 stay in the US, meaning that they DO NOT require employer sponsorship to participate in OPT.<\/p>\n\n\n\n<p>Students apply for and receive employment authorization through United States Citizenship &amp; Immigration Services (USCIS).&nbsp; A job offer is not required to apply for post-completion OPT. &nbsp;However, a student is limited to an aggregate of 90 days of unemployment during post-completion OPT, and any unemployment time counts as part of the 12-month limit. &nbsp;Once the student gains employment, it is his or her responsibility to submit this information to International Student Services.&nbsp; Additionally, all employees must be full-time (i.e., at least 21 hours per week).&nbsp; Students may begin working once they receive their Employment Authorization Documents (EAD) from USCIS, and the start date that is listed on their EAD has arrived.<\/p>\n\n\n\n<p><strong>I-9 Requirements<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>EAD or<\/li>\n\n\n\n<li>I-797 Receipt Notice for replacement EAD (if original EAD never arrived)<\/li>\n<\/ul>\n\n\n\n<p><strong>Social Security Number<\/strong><\/p>\n\n\n\n<p>Students are not required to have a job to receive OPT employment authorization.&nbsp; However, once they find a job, they will need to apply for a social security number.&nbsp; Please refer to the&nbsp;<a href=\"https:\/\/www.tarleton.edu\/admissions\/wp-content\/uploads\/sites\/179\/2022\/07\/SSN-Issuance-Guide_OPT.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Social Security Number Issuance Guide for OPT<\/a>&nbsp;if your employee needs to apply for a social security number.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-advgb-accordion-item advgb-accordion-item\" style=\"margin-bottom:15px\"><div class=\"advgb-accordion-header\" style=\"background-color:#4f2d7f;color:#eee;border-style:solid;border-width:1px;border-radius:2px\"><span class=\"advgb-accordion-header-icon\"><svg fill=\"#fff\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"24\" height=\"24\" viewBox=\"0 0 24 24\"><path fill=\"none\" d=\"M0,0h24v24H0V0z\"><\/path><path d=\"M12,5.83L15.17,9l1.41-1.41L12,3L7.41,7.59L8.83,9L12,5.83z M12,18.17L8.83,15l-1.41,1.41L12,21l4.59-4.59L15.17,15 L12,18.17z\"><\/path><\/svg><\/span><h2 class=\"advgb-accordion-header-title\" style=\"color:inherit\">Social Security Numbers<\/h2><\/div><div class=\"advgb-accordion-body\" style=\"border-style:solid !important;border-width:1px !important;border-color:undefined !important;border-top:none !important;border-radius:2px !important\">\n<p>International Students who want to work must apply for a Social Security Number (SSN) to report wages and income taxes to the Internal Revenue Service (IRS). Students must secure legal employment prior to applying for the issuance of an SSN. The Social Security Administration (SSA) requires proof of F-1 status (I-20 Form), Employment Offer Letter, and work authorization to apply for an SSN (Work Authorization Letter). <\/p>\n\n\n\n<p>Obtain an Employment Offer Letter from your employer to submit to <a href=\"mailto:internationalstudents@tarleton.edu\">internationalstudents@tarleton.edu<\/a>. Once our office receives the offer letter, the PDSO will provide a Work Authorization Letter for you to take with you to the SSA Office. The Employment Offer Letter must include the following information:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Employer&#8217;s name<\/li>\n\n\n\n<li>Supervisor&#8217;s name and contact information<\/li>\n\n\n\n<li>Start date<\/li>\n\n\n\n<li>Job title and responsibilities<\/li>\n\n\n\n<li>Number of hours per week you will work (must be no more than 20 hours per week except during authorized school breaks)<\/li>\n<\/ol>\n\n\n\n<p><a href=\"https:\/\/www.ssa.gov\/number-card\">Social Security Number and Card Information<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.ssa.gov\/locator\/\">Local Social Security Administration Office<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.ssa.gov\/pubs\/EN-05-10181.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">International Students and Social Security Numbers (SSA Publication No. 05-10181)<\/a><\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-advgb-accordion-item advgb-accordion-item\" style=\"margin-bottom:15px\"><div class=\"advgb-accordion-header\" style=\"background-color:#4f2d7f;color:#eee;border-style:solid;border-width:1px;border-radius:2px\"><span class=\"advgb-accordion-header-icon\"><svg fill=\"#fff\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"24\" height=\"24\" viewBox=\"0 0 24 24\"><path fill=\"none\" d=\"M0,0h24v24H0V0z\"><\/path><path d=\"M12,5.83L15.17,9l1.41-1.41L12,3L7.41,7.59L8.83,9L12,5.83z M12,18.17L8.83,15l-1.41,1.41L12,21l4.59-4.59L15.17,15 L12,18.17z\"><\/path><\/svg><\/span><h2 class=\"advgb-accordion-header-title\" style=\"color:inherit\">STEM OPT Extension<\/h2><\/div><div class=\"advgb-accordion-body\" style=\"border-style:solid !important;border-width:1px !important;border-color:undefined !important;border-top:none !important;border-radius:2px !important\">\n<p><strong>Employment Regulations<\/strong><\/p>\n\n\n\n<p>F-1 students in certain&nbsp;<a href=\"https:\/\/www.ice.gov\/doclib\/sevis\/pdf\/stemList2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">STEM majors<\/a>&nbsp;are eligible to apply for an additional 24 months of OPT employment authorization, known as&nbsp;<em>STEM OPT<\/em>.&nbsp; Although STEM OPT DOES NOT require employer sponsorship, STEM OPT employers do have some training obligations.<\/p>\n\n\n\n<p>Students on STEM OPT have reporting requirements that did not have while on post-completion OPT \u2013 some of which require employer participation.&nbsp; International Student Services strongly encourages potential STEM OPT employers to review the following websites for additional information about their requirements and responsibilities:&nbsp;<a href=\"https:\/\/studyinthestates.dhs.gov\/stem-opt-hub\/additional-resources\/stem-opt-extension-overview\">Study in the States: STEM OPT Extension Overview<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/students-and-exchange-visitors\/optional-practical-training-extension-for-stem-students-stem-opt\">USCIS: Optional Practical Training for STEM Students (STEM OPT)<\/a>.<\/p>\n\n\n\n<p>Students must have a job offer to apply for STEM OPT.&nbsp; To qualify for STEM OPT, the employer must meet the following requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The employer must be registered with E-Verify.<\/li>\n\n\n\n<li>Employment must be full-time (i.e., at least 21 hours per week).<\/li>\n\n\n\n<li>Employees must receive compensation.<\/li>\n\n\n\n<li>Employment must include a true employer-employee relationship.&nbsp; Staffing and temporary agencies may hire students on STEM OPT.&nbsp; However, the agency must be the entity that provides the practical training experience to the student at its place of business.&nbsp; It CAN NOT outsource the student\u2019s training to a third-party client.<\/li>\n\n\n\n<li>Employment is not volunteer work or self-employment.<\/li>\n\n\n\n<li>Employment must be directly related to the STEM degree field upon which the application for work authorization was based.<\/li>\n\n\n\n<li>Students may work for multiple employers while on STEM OPT.&nbsp; However, each employer and employment opportunity must meet ALL the above-mentioned requirements.<\/li>\n<\/ul>\n\n\n\n<p><strong>Working While STEM OPT Application Is Pending<\/strong><\/p>\n\n\n\n<p>Per federal regulation 8 CFR 214.2(f)(11)(i)(C), students who have timely filed their Form I-765 Application for Employment Authorization with USCIS to apply for STEM OPT will automatically receive a 180-day extension of their post-completion OPT work authorization.&nbsp; They may continue to work while their Form I-765 is pending, even if their EAD expires.&nbsp;&nbsp;<em>Timely filing<\/em>&nbsp;means that the student has filed their Form I-765 within the 90-day window before their post-completion OPT expires AND within the 60-day window after their DSO recommends them for STEM OPT in SEVIS.<\/p>\n\n\n\n<p><strong>Form I-983<\/strong><\/p>\n\n\n\n<p>While on STEM OPT, students and their employers must maintain an up-to-date&nbsp;<a href=\"https:\/\/www.ice.gov\/doclib\/sevis\/pdf\/i983.pdf\">Form I-983 Training Plan<\/a>.&nbsp; USCIS has provided employers with&nbsp;<a href=\"https:\/\/studyinthestates.dhs.gov\/stem-opt-hub\/for-employers\/employers-and-the-form-i-983\">instructions<\/a>&nbsp;explaining how to accurately complete this form.&nbsp; Each employer requires a separate Form I-983.<\/p>\n\n\n\n<p><strong>Initial Submission.<\/strong>&nbsp; As part of the STEM OPT application process, students must submit Form I-983 to International Student Services before their DSO enters their recommendation in SEVIS.&nbsp; This initial submission requires that the students and their employers fill out and sign pages 1-4 of Form I-983.<\/p>\n\n\n\n<p><strong>12-Month Check-In.&nbsp;&nbsp;<\/strong>F-1 students are required to check in with their DSO once they complete 12 months of STEM OPT training.&nbsp; As part of their required check-in, students must complete a self-evaluation and submit it to their DSO.&nbsp; The self-evaluation is on page 5 of their Form I-983 and requires them to obtain their supervisor\u2019s signature.<\/p>\n\n\n\n<p><strong>24-Month (or Final) Check-In.&nbsp;&nbsp;<\/strong>F-1 students are required to check in with their DSO once they complete 24 months of STEM OPT training.&nbsp; As part of their required check-in, students must complete a final self-evaluation and submit it to their DSO.&nbsp; The final self-evaluation is on page 5 of their Form I-983 and requires them to obtain their supervisor\u2019s signature.<\/p>\n\n\n\n<p>This final self-evaluation is also required of students whose employment ends prematurely due to a job change, layoff, or termination.<\/p>\n\n\n\n<p><strong>Making Substantial Changes to the I-983 After Employment Has Begun.&nbsp;&nbsp;<\/strong>If there are any significant changes to a student\u2019s employment, the student and their employer must complete a new Form I-983 and submit it to International Programs \u2013 Immigration.&nbsp;
